Dr Gabrielė Juodkaitė-Granskienė, Chair of the Criminal Cases Division of the Supreme Court of Lithuania, is currently participating in the annual conference of the European Law Institute (ELI), entitled “Europe and the Rule of Law: Cultural Engagement and Legal Resilience”, taking place in Paris.

The international event has brought together legal experts, judges, representatives of academia and other legal professions from across Europe and beyond. The conference addresses current issues relating to the rule of law, the administration of justice and the resilience of legal systems, as well as emerging challenges in various fields of law.

Dr G. Juodkaitė-Granskienė participated in the discussion “Sanctions Enforcement and Asset Freezing: Legal Principles and Challenges”, where participants shared the experiences of different European countries.

During the discussion, Dr G. Juodkaitė-Granskienė presented Lithuanian case-law concerning the enforcement of sanctions, asset freezing and confiscation. Drawing on principles developed by the Supreme Court of Lithuania, the Constitutional Court of the Republic of Lithuania and the European Court of Human Rights, she emphasised that the implementation of international decisions in Lithuania must be reconciled with national judicial procedures and constitutional guarantees of individual rights. Particular importance must be attached to an individual assessment in each case of the nature of the use of the property and the owner’s connection to unlawful activities.

“The recognition of international decisions cannot, in itself, automatically replace the national judicial procedure required for the confiscation of property. International recognition may provide a legal basis, but the deprivation of property in Lithuania will always require a clear legal basis, a procedure compliant with constitutional requirements, and effective judicial review,” emphasised Dr G. Juodkaitė-Granskienė.

Participation in the conference provided an opportunity to present Lithuanian judicial practice and exchange experience with judges and legal experts from other European countries. The event addressed current issues concerning the rule of law, the administration of justice, the resilience of legal systems, emerging technologies, judges’ workloads, the enforcement of sanctions and other challenges currently facing European legal systems. Discussing the experiences of different countries and practical solutions is important for gaining a better understanding of common challenges and identifying effective ways to address them.
